Terms of Service

Agreeing to Iamem Hosting’s Acceptable Use Policy and Terms of Service is mandatory for signing up or using our services. Please read everything carefully. If you have any questions, contact us at support@iamemhost.com.
Iamem Hosting is a brand operated by Iamem IT Consulting, a Proprietorship firm registered under the laws of the Republic of India, with its registered office at 13th Floor, Building No. 9, Raheja Mindspace IT Park, Mindspace, HITEC City, Madhapur, Hyderabad, Telangana — 500 081. All references to “Iamem Hosting”, “Iamem”, “we”, “us”, or “the Company” in these Terms refer to Iamem IT Consulting.
All clients of Iamem Hosting are subject to the following Terms of Service:
- Eligibility and Account Registration
You must be at least 18 years of age and legally capable of entering into a binding contract under Indian law to use Iamem Hosting’s services.
At the time of account creation and throughout your subscription, you must provide accurate, complete, and current information including your full legal name, postal address, email address, and phone number. Accounts with invalid or unverifiable contact details will be suspended. If correct details are not provided within 15 days of notification, the account will be permanently terminated without refund.
You are solely responsible for maintaining the security of your account credentials. Notify us immediately at support@iamemhost.com of any suspected unauthorised access.
- Billing and Payments
Payment Terms
All fees are payable in Indian Rupees (INR), inclusive of applicable GST at the prevailing rate (currently 18% for IT/hosting services). Iamem IT Consulting’s GSTIN will be stated on all invoices. Accounts are billed on the date of first activation and renew on the same date in each subsequent billing cycle.
Automatic Renewal
All hosting plans, domain registrations, and recurring services are set to auto-renew by default. Iamem Hosting will send a renewal reminder to your registered email address at least 7 days before the renewal date. It is your responsibility to ensure your payment details are current and to cancel before the renewal date if you do not wish to continue. No refund will be issued for a service that has been auto-renewed and a cancellation request is submitted after the renewal date.
Late Payments
Accounts that are past due may be suspended at Iamem Hosting’s discretion. We will make reasonable efforts to notify you before any suspension. Restoration of a suspended account may attract a reactivation fee.
Refund Policy
Iamem Hosting offers a 7-day money-back guarantee for new shared hosting plan purchases only, subject to the following:
- The refund request must be submitted in writing to support@iamemhost.com within 7 days of initial order activation.
- The guarantee applies only to first-time purchases of shared hosting plans. It does not apply to VPS, dedicated servers, managed services, renewals, or upgrades.
- Approved refunds will be processed to the original payment method within 7 to 10 business days.
The following are strictly non-refundable in all circumstances:
- Domain name registration, transfer, and renewal fees — once processed, these cannot be refunded in whole or in part, even if the domain is suspended, cancelled, or transferred before expiry.
- SSL certificates, once issued.
- Setup fees, migration fees, and custom development work.
- Accounts suspended or terminated for Terms or Acceptable Use Policy violations.
- Services purchased under promotional or discounted pricing.
Note: Nothing in this refund policy limits your statutory rights under the Consumer Protection Act, 2019, or the Consumer Protection (E-Commerce) Rules, 2020. You may contact the National Consumer Helpline at 1800-11-4000 if you believe your consumer rights have been violated.
- Cancellation Policy
How to Cancel
You may cancel any Iamem Hosting service at any time by submitting a cancellation request through the client portal at store.iamemhost.com or by sending a written cancellation request to support@iamemhost.com from your registered email address. Verbal or phone-based cancellation requests will not be accepted. All cancellations must be submitted in writing.
When Cancellation Takes Effect
Cancellations take effect at the end of the current active billing cycle. You will continue to have access to the service until that date. No pro-rata refund will be issued for any unused days remaining in the billing cycle, except where the 7-day money-back guarantee applies as stated in Section 2.
Notice Period
- Monthly plans: Cancellation request must be submitted at least 7 days before the next renewal date to avoid being charged for the following month.
- Annual plans: Cancellation request must be submitted at least 30 days before the renewal date. No refund will be issued for unused months of a prepaid annual term beyond the 7-day money-back window.
- Managed services and custom plans: 30 days’ written notice is required. Services will remain active during the notice period and the final month’s fee is payable in full.
Product-Specific Cancellation Rules
Shared and Reseller Hosting: Service is cancelled at the end of the current billing cycle. No pro-rata refund for unused time.
VPS and Dedicated Servers: Cancellation takes effect at the end of the current billing cycle. Resources provisioned (IP addresses, allocated storage, backups) are released at that point. No refund for remaining prepaid term.
Domain Names: Domain registrations cannot be cancelled mid-term. A domain will remain registered until its expiry date. If you do not renew, the domain will expire and enter a redemption period. Iamem Hosting is not responsible for the loss of a domain due to non-renewal. Domain deletion or release requests must be submitted in writing.
Email Hosting and SSL Certificates: Cancelled at end of billing cycle. SSL certificates, once issued, cannot be revoked or refunded.
Managed AWS and Cloud Services: Require 30 days’ written notice. Any AWS resource costs incurred during the notice period remain the customer’s responsibility.
Data Retrieval After Cancellation
Upon cancellation, your account and all associated data (website files, databases, emails) will remain accessible until the end of the active billing cycle. After expiry, data will be retained for a further 15 days, during which you may request a data export by contacting support@iamemhost.com. After this 15-day grace period, all data will be permanently and irrecoverably deleted. Iamem Hosting accepts no liability for data loss after this period.
Cancellation vs. Suspension vs. Termination
Cancellation means you have voluntarily chosen to end a service. Suspension means the service has been temporarily disabled, typically for non-payment or a policy violation — a suspended account is not cancelled and continues to accrue charges unless formally cancelled. Termination means the account has been ended by Iamem Hosting for a breach of these Terms — terminated accounts are not eligible for restoration. Please ensure you submit a formal cancellation request if you wish to stop being billed.
Cancellation Does Not Waive Outstanding Dues
Cancelling a service does not waive any outstanding fees owed to Iamem Hosting. Any unpaid invoices at the time of cancellation remain due and payable. Iamem Hosting reserves the right to pursue recovery of outstanding amounts.
- Acceptable Use Policy
Lawful Use Only
All services provided by Iamem Hosting must be used for lawful purposes only. You may not use our infrastructure to transmit, store, distribute, or facilitate any content or activity that violates any applicable Indian law, including but not limited to the Information Technology Act, 2000, the POCSO Act, 2012, the Copyright Act, 1957, the Digital Personal Data Protection Act, 2023, the Prevention of Money Laundering Act, 2002, and the Bharatiya Nyaya Sanhita, 2023.
Prohibited Content and Activities
The following are strictly prohibited on Iamem Hosting’s network and infrastructure:
- Child Sexual Abuse Material (CSAM) of any kind — see mandatory reporting clause below.
- Any obscene, pornographic, lascivious, or prurient content as defined under Section 67 of the IT Act, 2000.
- Hacking, cracking, network intrusion, or distribution of malware, ransomware, spyware, or phishing kits.
- Unsolicited bulk email (spam), mail bombing, or operation of open mail relay servers.
- Distribution of copyrighted content without authorisation.
- Anonymous proxies, VPN exit nodes for illegal activity, or IP spoofing tools.
- Cryptocurrency mining using shared hosting resources.
- IRC clients, IRC bots, or egg-drop scripts.
- Port scanners, DDoS tools, booter or stresser services.
- Fraud, phishing, identity theft, or impersonation.
- Content promoting terrorism, extremism, or incitement to violence.
- Domain parking farms, bulk domain registration under promotional offers for resale or brokerage purposes.
Child Sexual Abuse Material — Mandatory Reporting
Any account found to host, transmit, distribute, or link to child sexual abuse material (CSAM) will be immediately and permanently terminated without notice. Iamem Hosting will report the matter to the relevant law enforcement authorities under the POCSO Act, 2012 and Section 67B of the IT Act, 2000, the Indian Cyber Crime Coordination Centre (I4C) at cybercrime.gov.in, and CERT-In as required by law. No refund will be issued.
Unlimited Hosting — Fair Use
“Unlimited” hosting plans operate in a shared server environment and are subject to fair use constraints. Sustained CPU usage exceeding 25% of a single core for more than 90 seconds may be throttled. Inode limits apply (typically 250,000 per account). No single account may impact the performance of other accounts on the same server. Accounts consistently exceeding fair use thresholds will receive a written warning; if usage is not reduced within 48 hours, Iamem Hosting reserves the right to migrate the account to an appropriate VPS plan.
CGI Scripts
Each hosting account includes a cgi-bin directory. You may run CGI scripts provided they do not adversely affect server performance or security. Iamem Hosting reserves the right to disable any script causing server disruption without prior notice. Software may only be hosted if you are the legal copyright owner or hold a valid licence for it.
Background Processes
Persistent background daemons are not permitted on shared hosting plans. Requests for background processes on VPS or dedicated plans will be evaluated on a case-by-case basis and may attract additional charges.
- Anti-Spam Policy
Iamem Hosting operates a zero-tolerance anti-spam policy. You may not use our servers or services — directly or indirectly — to send, relay, or facilitate unsolicited bulk email (spam), mail bombs, or similar communications. Your domain may not be referenced as the originator, intermediary, or reply-to address in any spam campaign.
Violations will result in:
- First violation: Immediate suspension of mail services pending investigation and remediation.
- Second violation: Termination of account without refund.
- Iamem Hosting reserves the right to recover costs incurred due to spam activity (including IP delisting fees, abuse handling, and legal costs) from the responsible customer.
- Data Protection and Privacy
Compliance with the DPDP Act, 2023
Iamem Hosting processes personal data in accordance with the Digital Personal Data Protection Act, 2023. We implement appropriate technical and organisational measures to protect personal data against unauthorised access, loss, or destruction.
Customer Responsibilities
You are responsible for ensuring that personal data of your end users stored on Iamem Hosting’s infrastructure is collected, processed, and retained in compliance with the DPDP Act, 2023 and all applicable data protection laws. You must:
- Ensure your applications are properly validated and secured before collecting sensitive data from end users.
- Implement appropriate security controls including input validation, SQL injection prevention, and secure authentication.
- Notify Iamem Hosting promptly at security@iamemhost.com if you become aware of any data breach involving data hosted on our infrastructure.
Data Breach Notification
In the event Iamem Hosting becomes aware of a data breach affecting your hosted data, we will notify you within 72 hours and cooperate with your obligations to notify the Data Protection Board of India and affected data principals as required by law.
Data Retention
Iamem Hosting retains customer account data for the duration the account is active and for 6 months after account closure, after which data is securely deleted unless retention is required by law.

- Backup Policy
Iamem Hosting performs periodic server-level backups of websites, cgi-bin directories, email data, and associated files on a best-effort basis. These backups are intended solely for our operational continuity and disaster recovery purposes.
Note: Iamem Hosting does not guarantee the availability, completeness, or restorability of any backup. You are solely responsible for maintaining independent, current backups of all your data, including MySQL/MariaDB databases. Each hosting control panel provides backup utilities for this purpose. Iamem Hosting accepts no liability for data loss arising from your failure to maintain independent backups.
Restoration from Iamem Hosting’s server-level backups, where available, may be performed upon written request and is subject to a restoration fee as published in our support documentation.
- Service Level Agreement (SLA) and Uptime
Uptime Commitment
Iamem Hosting targets a monthly uptime availability of 99.9% for shared hosting and managed VPS services, measured on a calendar month basis, excluding scheduled maintenance and force majeure events.
Service Credits
If monthly uptime falls below 99.9%, customers may request a service credit as follows:
- Uptime 99.0% – 99.89%: Credit of 5% of the monthly fee for the affected service.
- Uptime 95.0% – 98.99%: Credit of 15% of the monthly fee for the affected service.
- Uptime below 95.0%: Credit of 25% of the monthly fee for the affected service.
Credit claims must be submitted to support@iamemhost.com within 7 days of the end of the affected month. Credits are applied to the next invoice and are not redeemable for cash.
Scheduled Maintenance
Iamem Hosting will provide at least 48 hours’ advance notice via email and/or our status page before scheduled maintenance that is expected to cause service interruption. Emergency maintenance may be performed with shorter or no notice to protect network integrity and security.
- Suspension and Termination
Suspension with Notice
For non-egregious violations (such as excess resource usage, minor Acceptable Use Policy breaches, or billing disputes), Iamem Hosting will provide at least 48 hours’ written notice via email and an opportunity to remedy the violation before suspending services.
Immediate Suspension
Iamem Hosting reserves the right to immediately suspend or terminate services without prior notice in the following circumstances:
- Discovery of CSAM or illegal content on the account.
- Active spam campaign originating from the account.
- Active DDoS attack, network intrusion, or security compromise originating from the account.
- Imminent threat to the security or integrity of Iamem Hosting’s infrastructure.
- Order or requirement of a competent court or law enforcement authority.
Data Retrieval after Termination
Accounts terminated for Acceptable Use Policy or Terms violations are not eligible for restoration. We will provide access to retrieve your data for 7 days following termination (except where prohibited by law or court order), after which all data will be permanently deleted.
- Intellectual Property
Iamem Hosting and its licensors retain all intellectual property rights in our website, software, branding, documentation, and related materials. You are granted a limited, non-exclusive, non-transferable licence to use our services for your own lawful purposes during the term of your subscription.
All content uploaded to or hosted on Iamem Hosting’s infrastructure must be owned by you or licensed to you. You must not host content that infringes the intellectual property rights of any third party under the Copyright Act, 1957, or any other applicable law.
- Indemnification
You agree to defend, indemnify, and hold harmless Iamem IT Consulting, its proprietor, employees, agents, and associates from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of Iamem Hosting’s services in violation of these Terms, the Acceptable Use Policy, or any applicable law.
- Any content uploaded, stored, transmitted, or made accessible through your account.
- Any claim that your content infringes the rights of any third party.
- Any injury to persons or property caused by products or services offered through your account.
- Your failure to comply with the DPDP Act, 2023, or any other data protection obligation.
- Limitation of Liability
To the maximum extent permitted by applicable Indian law:
- Iamem Hosting’s total cumulative liability for any claim shall not exceed the total fees paid by you to Iamem Hosting in the 3 months immediately preceding the event giving rise to the claim.
- Iamem Hosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption.
- Iamem Hosting shall not be liable for service interruption caused by circumstances beyond our reasonable control, including upstream provider outages, backbone failures, natural disasters, or government orders.
Note: Nothing in these Terms limits Iamem Hosting’s liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any liability that cannot be excluded or limited under Indian law, including under the Consumer Protection Act, 2019.
- Disclaimer of Warranties
Iamem Hosting’s services are provided on an “as is” and “as available” basis. We make no representations or warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the extent permitted by applicable law.
We do not warrant that the services will be uninterrupted, error-free, or free from viruses or other harmful components. You are responsible for implementing sufficient security measures and backup procedures to protect your data and systems.
- Force Majeure
Iamem Hosting shall not be liable for any delay or failure in performance where such delay or failure results from circumstances beyond our reasonable control, including:
- Acts of God, natural disasters, or extreme weather events.
- War, civil unrest, terrorism, or government-imposed sanctions or orders.
- Pandemics, epidemics, or public health emergencies declared by competent authorities.
- Failure of upstream internet infrastructure, backbone providers, or power grid failures.
- Actions of third-party vendors, cloud providers (including AWS), or domain registrars.
Iamem Hosting will notify affected customers as soon as reasonably practicable and will use commercially reasonable efforts to restore services as quickly as possible.
- Dispute Resolution
Step 1 — Internal Complaint Resolution
If you have a complaint regarding Iamem Hosting’s services, please contact our Grievance Officer in writing first. We will acknowledge your complaint within 24 hours and aim to resolve it within 15 days of receipt.
Step 2 — Mediation
If the complaint is not resolved through internal resolution, either party may request mediation before a mutually agreed mediator in Hyderabad, Telangana, India.
Step 3 — Arbitration
If mediation does not result in a resolution, any dispute arising out of or in relation to these Terms shall be finally settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended. The arbitration shall be conducted by a sole arbitrator, in the English language, in Hyderabad, Telangana, India.
Jurisdiction
Subject to the arbitration agreement above, the courts at Hyderabad, Telangana, India shall have exclusive jurisdiction. Nothing in this section limits your right to approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Iamem Hosting has designated a Grievance Officer. Complaints and notices may be addressed to:

The Grievance Officer shall acknowledge all complaints within 24 hours and resolve them within 15 days of receipt. For CSAM or illegal content reports, Iamem Hosting will act within 24 hours of receipt.
- Modifications to These Terms
Iamem Hosting reserves the right to revise these Terms at any time. In the case of material changes, we will send a notification email to your registered email address at least 15 days before the changes take effect, and post a prominent notice on our website and client portal.
Your continued use of Iamem Hosting’s services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not accept the revised Terms, you must cease using the services before the effective date and notify us in writing.
- Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. The following Acts (and rules framed thereunder) are particularly applicable:
- Information Technology Act, 2000
- IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
- Digital Personal Data Protection Act, 2023
- Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020
- The Copyright Act, 1957
- POCSO Act, 2012
- Arbitration and Conciliation Act, 1996
In any event of dispute, the area of jurisdiction shall be Hyderabad, Telangana, India only.
- General Provisions
Entire Agreement
These Terms, together with the Privacy Policy and any service-specific addenda, constitute the entire agreement between you and Iamem Hosting and supersede all prior negotiations, representations, or agreements.
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver
No waiver by Iamem Hosting of any breach of these Terms shall be deemed a waiver of any subsequent breach.
Notices
All legal notices to Iamem Hosting must be sent in writing to the Grievance Officer address above. Notices to you will be sent to your registered email address and shall be deemed received within 24 hours of sending.
